Public Offer Agreement for Accommodation Services

This document constitutes an offer from LLC “OPTIMALPROMSNAB” (operating as Hotel “Ordynka+”) addressed to individuals, inviting them to conclude a paid agreement for accommodation services under the terms set forth below, in accordance with Clause 2 of Article 437 of the Civil Code of the Russian Federation.
1. Definitions
For the purposes of this document, the following terms shall have the meanings indicated:
- Offer – this document, published on the Executor’s website.
- Acceptance of the Offer – full and unconditional acceptance of the Offer by performing the actions specified in Clause 2.2.1.
- Agreement – a paid contract between the Executor and the Customer for the provision of accommodation services, concluded through Acceptance of the Offer.
- Executor – LLC “OPTIMALPROMSNAB” (Hotel “Ordynka+”).
- Customer – an individual who has accepted the Offer.
- Parties – the Executor and the Customer, jointly referred to.
- Website – the collection of electronic documents published by the Executor at: https://hotelordynka.ru/
- Accommodation Facility – a real estate property intended for temporary lodging (hotel), information about which is published on the Website.
- Services / Accommodation Services – the Executor’s activities related to room reservation, guest accommodation, and daily amenities, as defined in this Offer.
2. Subject of the Agreement
2.1. The subject of this Agreement is the paid provision by the Executor to the Customer of accommodation services in accordance with the terms of this Offer and the rates published on the Executor’s Website.
2.2. Provision of Services is conditional upon:
a) confirmation by the Executor of availability (subject to room availability for the requested period);
b) full prepayment by the Customer.
3. Procedure for Providing Services
3.1. Reservation
3.1.1. Rooms may be reserved via:
– completing the booking form on the Website;
– sending a request to info@hotelordynka.ru;
– calling +7 (916) 280-93-89 to book through the front desk;
– using third-party booking platforms (e.g., Yandex.Travel, Ostrovok.ru, etc.).
3.1.2. Upon confirmation of availability, the Executor will send the Customer a reservation confirmation email. The room is considered provisionally reserved from the moment the Customer receives this confirmation.
3.1.3. To extend a reservation, the Customer must notify the Executor no later than 3 days before the scheduled check-out date. Otherwise, the room may be released to another guest.
3.2. Check-in and Stay
3.2.1. The room is provided on the agreed check-in date. The Customer must make full prepayment at check-in. Payment constitutes Acceptance of the Offer and concludes the Agreement. A receipt and cash register slip will be issued.
3.2.2. Check-in requires presentation of a valid government-issued ID (passport or equivalent). Failure to provide such documentation will result in denial of accommodation.
3.2.3. The Executor guarantees that all Services meet the standards appropriate to the hotel’s category and the terms of this Agreement.
3.2.4. The terms of stay are governed by the “Rules of Accommodation and Conduct at Hotel Ordynka+”, published on the Website.
4. Rights and Obligations of the Parties
4.1. Executor’s Obligations:
- Provide clear information on accommodation terms and house rules.
- Confirm reservations when rooms are available.
- Deliver Services in accordance with the Agreement.
- Perform daily cleaning and change bed linens at least every 3 days.
4.2. Executor’s Rights:
- Refuse accommodation if the guest presents false documents, is intoxicated, or violates house rules.
- Engage third parties to fulfill obligations under this Agreement.
- Notify the Customer of required actions.
4.3. Customer’s Rights:
- Review accommodation terms prior to booking.
- Receive updates on service delivery.
4.4. Customer’s Obligations:
- Hold valid legal identification and residency documentation.
- Pay for Services in full at check-in.
- Read and comply with the “Rules of Accommodation and Conduct”.
5. Payments
5.1. Service fees are based on the rates published on the Website at the time of booking and are specified in the payment receipt.
5.2. Services are not subject to VAT under Chapter 26.2 of the Russian Tax Code (simplified taxation system).
5.3. Discounts may be applied at the Executor’s discretion and will be reflected in the receipt.
5.4. No-shows or early departures incur a penalty equal to one night’s stay. Refunds for unused nights (beyond the penalty) are processed upon request.
5.5. Accepted payment methods: cash, bank transfer, and credit/debit cards.
6. Acceptance of Services
6.1. Services are deemed fully and properly rendered unless the Customer submits written, justified objections within 10 days after check-out.
6.2. Claims regarding service quality, quantity, or cost submitted after this period will not be considered.
7. Liability
7.1. The Customer is fully liable for any damage caused to the Executor’s property (intentional or accidental) and must compensate for the full market value of losses within 5 days of notification.
7.2. The Customer indemnifies the Executor against all claims, fines, or legal actions arising from the Customer’s conduct.
7.3. In case of breach of this Agreement, the Executor may:
a) suspend Services until violations are remedied;
b) restrict access to the room;
c) terminate the Agreement and retain payments to cover penalties and damages.
7.4. The Executor’s liability is limited to the total amount paid by the Customer under this Agreement.
7.5. The Executor is not liable for subjective dissatisfaction with Services.
7.6. Neither Party is liable for failure to perform obligations due to force majeure (e.g., natural disasters, government actions). The affected Party must notify the other within 15 days of the event.
8. Term, Amendment, and Termination
8.1. The Offer becomes effective upon publication on the Website and remains valid until revoked.
8.2. The Executor may amend or withdraw the Offer at any time. Changes take effect immediately upon publication on the Website.
8.3. The Agreement is formed upon Acceptance (payment at check-in) and remains in force until:
a) all obligations are fulfilled; or
b) the Agreement is terminated.
8.4. Termination may occur:
a) by mutual agreement;
b) by either Party with 10 days’ written notice;
c) as otherwise provided in this Offer.
8.5. Once concluded, the price of Services cannot be unilaterally changed.
9. Warranties
By accepting this Offer, the Customer confirms that:
- They enter the Agreement voluntarily;
- They have read, understood, and accept all terms;
- They possess full legal capacity to conclude this Agreement.
10. Miscellaneous
10.1. Matters not covered herein are governed by the laws of the Russian Federation.
10.2. Section headings are for convenience only and do not limit interpretation.
10.3. If any provision is deemed invalid, the remainder of the Agreement remains in full force.
